29 CFR 1910.178(m)(5)(ii): A powered industrial truck was left unattended when the operator is 25 ft. or more away from the vehicle which remains in view, or whenever the operator leaves the vehicle and it is not in view: (a) On or before 4/4/2023 the employer allowed employees to use a 2016 Toyota powered industrial truck, model 8FGU30 and Serial #65606 to open a non-operational overhead roll-up freight door so vendors could move through the door opening. The freight door, which measured 22' x 20', was propped open using the forklift with the forks/tines elevated to maximum height on multiple occasions while the door was not operational.

29 CFR 1910.178(m)(6): The employer did not ensure that safe distance was maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car. Trucks shall not be used for opening or closing freight doors: (a) On or before 4/4/2023 the employer allowed employees to use a forklift to open a non-operational freight door, so vendors could move through the door opening. The freight door, which measures 22' x 20', was propped open using a Toyota forklift with the forks elevated to maximum height over the period of 5 days while the door was not operational.
