29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:                                                                a) 193 Maple Street, Teaneck, NJ/Roof: The employer deliberately did not instruct each employee on the unsafe condition of using RGC Material Hoist as a ladder to access a two-story residential house on or about 5/15/2023. Manufacturer's operations manual and manufacturer's  label  on the RGC Material Hoist used as a ladder specifies "Do Not Climb! Materials Hoist Only." The Owner and the Foreman deliberately did not train the employees on how to control or eliminate this hazard.

The exposed employee was using only a body belt as part of a personal fall arrest system.    b) 193 Maple Street, Teaneck, NJ/Roof: On or about 5/15/2023, employees installing shingles on a residential house with a 10 on 12 pitch roof were exposed to a fall hazard of approximately 20 feet and were not  protected by a personal fall arrest system or any other means of fall protection.
