29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  At the jobsite located at 15763 Braly Blvd, Athens, AL 35611 on or about May 31, 20233, employees were exposed to forklift related hazards, in that, forklift operators did not receive formal training for power industrial trucks but were allowed to operate forklifts, exposing them to crush-by and struck-by hazards.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  At the jobsite located at 15763 Braly Blvd, Athens, AL 35611 on or about 05/31/2023, the employer exposed employees to fall hazards in that fall protection was not utilized while framing operations were being conducted on a commercial structure while working at approximately 30 feet in height.  Roberto Martinez dba Martinez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1352858, citation number 1 item number 1 and was affirmed as a final order on 11/09/2018, with respect to a workplace located at 320 Commons Drive, Birmingham, AL, 35209.
