29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about July 18, 2023, the employer failed to ensure that intake operators were protected from falling through a gap between the walkway's guardrail and/or a hole opening at the top of the tankard. While intake operators gathered samples their body was positioned below the bottom rail.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  On or about July 11, 2023, training on the purpose and function of the energy control program was not provided to maintenance personnel engaged in valve replacements in the intake area. Knowledge and skills required for the safe application, usage, and removal of the energy controls were not acquired by employees as sustained thermal and fall injuries as a result.
