29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) On September 14, 2023, an employee was grinding down a corner on a concrete ledge with a 4 1/2-inch Milwaukee handheld grinder without a guard on the grinder and not wearing eye or face protection.

29 CFR  1926.300(b)(1):Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use.  a) On or about September 14, 2023, an employee was observed using a Milwaukee grinder (Serial No. H40CD201601100) without a guard and was exposed to injuries such as (but not  limited to) kickback and/or high speed flying particles.
