29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  a.   On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR.  Employees performing marine construction related activities standing inside the water from a working platform with an electrical tool were not trained on the hazards related to electrical and proper use and operation of the electrical tool.   NOTE:	Documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(d).

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure, and which are in use by employees did not have approved ground fault circuit interrupters for personal protection:  a.   On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR.  Employees performing marine construction related activities standing inside the water from a working platform were working with an electrical tool connected with a defective/nonoperational ground-fault circuit interrupter.   b. On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR. Employees performing marine construction related activities were working with an electrical tool connected to a receptable at the end of the electrical cord not being protected with a ground-fault circuit interrupter.   NOTE: 	Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.

Employees were exposed to electrical and drowning hazards as employees engaged in marine construction were standing inside the water from a working platform with an electrical tool.  The electrical tool being used was connected to an electrical receptacle not protected against the weather and water elements.        NOTE: 	Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.

29 CFR  1926.416(a)(3): The employer began work without determining if employees could contact any part of an energized circuit:   a.   On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR.  Employees were exposed to electrical and drowning hazards as employees engaged in marine construction were standing inside the water from a working platform with an electrical hand tool.  The employer did not to take the necessary steps to determine whether or not there was buried electrical equipment that could have been contacted while performing work.     NOTE: 	Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
