OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm  to employees in that employees were exposed to crush-by and struck-by hazards.  (a) On or about January 23, 2024, at Holey Land Wildlife Management Area (2633303 N, 80.778387 W), Fort Lauderdale, FL 33332, the employer did not ensure employees were adequately trained on personnel lifting system operations associated with the Elliott 40132 Boom Truck, Serial No. 007231; VIN No. 1NPCXJEX2KD263373.  Among other methods, feasible and acceptable means of abatement would be to follow the guidance provided in ASME B30.23, including but not limited to:  23.3.1.2(a)(1): Hoisting equipment operator. The operator shall be qualified to operate the specific type of hoisting equipment used in the personnel lift. 23.3.1.2(b): Responsibilities. The operator shall be responsible for complying with the requirements of this Volume with regard to (1) hoisting equipment capability, (2) rated load constraints; (3) operational limitations; (4) confirming that all hoisting equipment inspections have been completed and are satisfactory, prior to starting the lift; (5) operating the hoisting equipment in compliance with the procedures specified in this Volume; and (6) those operations under the operator?s direct control.
