29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:   On or about June 3, 2024, the employer failed to instruct each employee in the recognition and avoidance of unsafe conditions created by the boom of an excavator and steel road plates which were placed at the end of a trench box. Employees attaching chain slings from the boom of an excavator to the plates rely on a spotter and the spotter was not trained to recognize hazards and convey when employees may be in a blind spot. As a result, an excavator operator continued to move the boom of the excavator crushing an employee between the steel road plate and boom of the excavator resulting in employee injury.
