OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from objects due to defective  guards/shields on CNC milling machines:  a.) Esmark Excalibur LLC DBA Excalibur Machine, 9723 US Highway 322 Conneaut Lake, PA 16316: On or about 06/25/2024 and at times prior thereto, the guarding on the Haas VF11 CNC milling machine in the machine shop area was damaged/modified in ways including but not limited to; cracks in the windows, missing pieces of windows, and cut/fabricated metal guarding. Modifications allowed machine chips to escape the machine into the adjacent shop area.  NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a.) Esmark Excalibur LLC DBA Excalibur Machine, 9723 US Highway 322 Conneaut Lake, PA 16316: On or about 06/11/2024 and at times prior thereto, Employees are exposed to hazards associated with rotating parts at the Toshiba BP-150.R22 Horizontal Boring Mill. The Toshiba Horizontal Boring Mill does not have guarding to prevent the operator from entering the mill.
