29 CFR  1926.652(a)(1)(ii):29 CFR 1926.652(a)(1)(ii):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph 29 CFR 1926.652(b) or 29 CFR 1926.652(c) of this section except when: excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.    On or about July 23rd, 2024, employees of Shaw Services LLC working in a trench at the work site were exposed to cave-in hazards due the employer failed to examine the ground to determine that there was no indication of a potential cave-in.
