29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  On or about October 29, 2024, an employee was conducting servicing on a TerraGator fertilizer with an unprotected side that was approximately 6ft. 1in. and was not protected from falling.  The employee was in the process of opening the cab lid, when the employee lost balance and fell, suffering broken bones.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard:   On or about October 29, 2024, an employee was conducting servicing on a TerraGator fertilizer with an unprotected side that was approximately 6ft. 1in. and the employer did not ensure employees were trained on the following topics:   (i) The nature of the fall hazards in the work area and how to recognize them;  (ii) The procedures to be followed to minimize those hazards;  (iii) The correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses; and  (iv) The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.
