29 CFR  1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  The employer is failing to ensure the Toyota Forklift (Model: 8FGC55U-PRS, Serial Number: 11088) is removed from service when the tires are unserviceable and unsafe to operate. Material Handler employees are exposed to crushing and struck-by hazards while operating the vehicle when the employer fails to remove the vehicle from service when the truck's tires are missing chunks and have severe splitting of the sidewalls. This was most recently documented on February 4, 2025, in Plant 2, which is located at 2441 East Glendale Avenue in Appleton, Wisconsin.  Progressive Converting, Inc. DBA ProCon was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.178(p)(1), which was contained in OSHA inspection number 1720451, citation number 1, item number 2 and was affirmed as a final order on March 21, 2024, with respect to a worksite located at 2441 East Glendale Avenue, Appleton, Wisconsin.
