29 CFR 1915.152(b): The employer did not assess its work activity to determine whether there were hazards present, which necessitate the employee's use of personal protective equipment: a) 4101 Washington Ave. Newport News: On or about February 2, 2025, employees conducted gas tungsten arc welding as part of the employer's welding school. A personal protective equipment assessment was not conducted by the employer to address the required personal protective equipment to be used by the employees. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.157(b): The employer did not ensure that employees wore clothing that was not impregnated or covered in part with flammable or combustible materials while engaged in hot work operations or working near an ignition source: a) 4101 Washington Ave. Newport News: On or about February 2, 2025, employees conducting gas tungsten arc welding wore clothing made from synthetic materials such as polyester and non-flame retardant/resistant cotton exposing employees to burn hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
