OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushed-by and struck-by hazards from Industrial Steel Storage Racks.   a) On or about February 4, 2025 at the warehouse located at 1100 South 86th Street, TAMPA, FL 33619, employees unload products from the trucks to/from the Industrial Storage Racks, during which the rack end was found to have a severely decreased load capacity due to structural damage, defects and/or safety deficiencies,  caused by forklift collisions, resulting  in potential structural collapse; therefore exposing employees to crushed-by and struck-by hazards.    b) On or about February 4, 2025 at the warehouse located at 1100 South 86th Street, TAMPA, FL 33619, employees unload products from the trucks to/from the Industrial Storage Racks, during which the second tier was found to bent (Aisle #3) and have a severely decreased load capacity due to structural damage, defects and/or safety deficiencies,  resulting  in potential structural collapse; therefore exposing employees to crushed-by and struck-by hazards.    c) On or about February 4, 2025, at the warehouse located at 1100 South 86th Street, TAMPA, FL 33619, employees were exposed to crush-by and struck-by hazards, in that, upon visible damage, the employer did not isolate the damaged portions of the rack system.   d) On or about February 4, 2025, at the warehouse located at 1100 South 86th Street, TAMPA, FL 33619, employees were exposed to crushed-by and struck-by hazards, in that, the employer has not performed periodic inspections of the rack system in the warehouse for damages.
