29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a) Ridge Lea Road, Amherst, New York - On or about 4/9/2025 - employees were in an excavation to tie the sewer into the main. The excavation was approximately 8' to 9' deep with walls not adequately sloped and not properly protected from cave-ins. The soil and excavation were not inspected by a competent person to evaluate soil conditions and proper protective measures.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):  a) Ridge Lea Road, Amherst, New York - On or about 4/9/2025 - employees were in an excavation to tie the sewer into the main. The excavation was approximately 8' to 9' deep with walls not adequately sloped and not properly protected from cave-ins.   NO ABATEMENT CERTIFICATION REQUIRED  716 Site Contracting Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard,  which was contained in OSHA inspection number 1605419, citation number 1, item number 1 and was affirmed as a final order on 10/19/2022, with respect to a workplace located at 280 Aris Avenue, Buffalo, New York.
