29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) 7409 Atlantic Ave., Margate City, 08402: Workers engaged in roofing and other related activities were exposed to fall hazards, up to and more than 40 feet to the ground surface below, when walking on and working on a roof of a residential structure without the use of fall protection. Condition observed on or about 08/28/2025.  The Fortex Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1813384, citation number 1 , item number 1 and was affirmed as a final order on 06/25/2025, with respect to a workplace located at 2801 Creek Road, Hainesport, NJ 08036.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) 7409 Atlantic Ave., Margate City, 08402: Workers were not utilizing fall protection and were exposed to fall hazards up to 40 feet to the ground surface below when performing roofing installation and other related activities at the worksite.   The workers have not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  Condition observed on or about 08/28/2025.  The Fortex Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(2), which was contained in OSHA inspection number 1813384, citation number 1 , item number 2 and was affirmed as a final order on 06/25/2025, with respect to a workplace located at 2801 Creek Road, Hainesport, NJ 08036.
