29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) Jobsite, 347 West Penn Avenue Robesonia, PA - On or about December 1, 2025, employees engaging in framing carpentry work on the second story of an apartment complex were not protected by the use of fall protection, exposing them to a fall hazard of approximately 11 feet above the lower level, as there were inadequacies in the affected employee's knowledge of the use of fall protection systems or equipment indicating that the employees had not retained the requisite understanding or skill. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
