29 CFR 1926.1408(a)(1): The Employer failed to identify the work zone by either demarcating the boundaries and prohibiting the operator from operating the equipment past those boundaries, or defining the work zone as the area 360 degrees around the equipment, up to the equipment's maximum working radius:  a)  On or about February 10, 2026, the employer did not identify the work zone as the area 360 degrees around the equipment's maximum working radius by either demarcating the boundaries or prohibiting the equipment to operate past that boundary.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1408(a)(2): The equipment's maximum working radius could get closer than 20 feet to a power line and the employer did not meet the requirements in Option (1), Option (2), or Option (3) of this section:  a) On or about February 10, 2026, the employer operated a crane within 20 feet of an energized power line having a voltage rating of up to approximately 138 Kv without meeting the requirements outlined in Option (1), Option (2), or Option (3) of this section.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
