Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of severe lacerations and amputation where exposure to fish processing equipment that had not been properly locked out and/or tagged out occurred; the following conditions contributed to the existence of these hazards: (a)F/V Arctic Fjord, processing area: Where an engineer and a process machine operator were working on a processing machine and potentially exposed to numerous nip points and rotating and operating components of equipment that was designed to dehead, eviscerate, and filet fish, the only energy isolation device in place was a single tag affixed to the emergency stop button at the machine panel; the following program deficiencies and physical hazards were noted: (1)The lockout/tagout program developed and implemented by the vessel lacked specific procedural steps for shutting down and securing the equipment prior to commencing maintenance work. (2)Where more than one employee was engaged in performing work on the equipment, there was no group lockout/tagout procedure developed. (3)The developed procedure contained no provision for verification of isolation. (4)The developed procedure contained no provision for release from the tagout. (5)Not all energy isolation devices that were needed to control the energy to the equipment were physically located and operated in such a manner as to isolate the equipment from the energy source. (6)There was no periodic inspection of the energy control procedures to ensure that the procedure that had been developed was appropriate and being followed. Note: One feasible means of abatement, among others, is to develop a program consisting of energy control procedures, employee training, and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment must be isolated from the energy source and rendered inoperative.
