OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. On or about 11/26/20120, an employee was exposed to a 15 foot fall hazard while accessing a lower roof eve. The employee climbed the guardrails of a Skyjack Model # SJ1113219 to access the lower roof eve of the building.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a. On or about  11/26/2012, employees were exposed to a struck by hazard, in that, no hard hats were worn to protect them from falling debris and tools while the lower roof eve was being reconstructed at the Walgreens at 11115 E Martian Luther King Blvd.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. On or about 11/26/12, an employee was observed standing on the lower roof eve of a Walgreens at 11115 E Martian Luther King BLVDJR. BLVD 15 feet above the ground with no fall protection.     Honors Contractors Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 316417963 citation number 2, item number 1 and was affirmed as a final order on 05/10/12 in respect to a work place located at West Swann Ave and Henderson Blvd. in Tampa, FL.
