29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a.  An employee working as Welder #8 working in fabrication, was exposed to continuous noise at 52.8% which exceeds the action level of 50% (an 8 hour time weighted average {TWA} sound level of 85 dBA) for instituting a hearing conservation program.  The 8-hour TWA sound level was approximately 85.4 dB during the 395 minutes sampling period on March 12, 2014.  Exposure calculations included a zero increment for the 85 minutes not sampled.    b.  An employee working as Welder #9 working in fabrication, was exposed to continuous noise at 124% which exceeds the action level of 50% (an 8 hour time weighted average {TWA} sound level of 85 dBA) for instituting a hearing conservation program.  The 8-hour TWA sound level was approximately 87.6 dB during the 413 minutes sampling period on March 12, 2014.  Exposure calculations included a zero increment for the 67 minutes not sampled.    c.  An employee working as Welder #10 working in fabrication, was exposed to continuous noise at 75.5% which exceeds the action level of 50% (an 8 hour time weighted average {TWA} sound level of 85 dBA) for instituting a hearing conservation program.  The 8-hour TWA sound level was approximately 87.5 dB during the 412 minutes sampling period on March 12, 2014.  Exposure calculations included a zero increment for the 68 minutes not sampled.    d.  An employee working as Welder #11 working in fabrication, was exposed to continuous noise at 178% which exceeds the action level of 50% (an 8 hour time weighted average {TWA} sound level of 85 dBA) for instituting a hearing conservation program.  The 8-hour TWA sound level was approximately 88 dB during the 478 minutes sampling period on March 12, 2014.  Exposure calculations included a zero increment for the 2 minutes not sampled.

9 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).    a.  At the work site, employees who operated a plasma cutting table and laser seamer for stainless steel and aluminum were provided by the employer with tight fitting half-face respirators for voluntary use.  Other employees voluntarily wore tight fitting half-face respirators while grinding the stainless steel and aluminum sheets.  The employer did not have a written respiratory program.
