29 CFR 1910.252(a)(2)(xiv)(C)(2): The employer did not ensure that if the work could not be moved, that the supervisor would have had the combustibles moved to a safe distance from the work or the combustibles properly shielded against ignition: (a) On or about March 31,2015 nine stacks of pallets were near the billet torch cutting process creating a potential fire hazard. The supervisor did not ensure that the stacked pallets were relocated.

29 CFR 1910.252(a)(2)(xiii)(C): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, and did not insist that cutters or welders and their supervisors were suitably trained in the safe operation of their equipment and the safe use of the process. (a) On or about March 31,2015 stacks of pallets were near the billet torch cutting process creating a potential fire hazard. The billet cutting operator did not recognize the potential fire hazard of close proximity combustibles, closer than 35 feet.
