29 CFR  1910.134(l)(1): The employer shall conduct evaluations of the workplace as necessary to ensure that the provisions of the current written program are being effectively implemented and that it continues to be effective.   (a) On or about  July 15,2021 , and at times prior thereto, the employer failed to conduct evaluations and implement its current written respirator program to ensure that employees that are required to wear respirators are medically evaluated, fit tested and trained in the use and care of respirators to prevent employee injury and illness.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  (a) On or about July 15, 2021, and at times prior thereto, the employer modified the electric stacker serial number 17108737 by extending the tines of the powered industrial vehicle without getting the manufactures written approval.
