29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about 06/16/2016, the employer failed to ensure that the discharge spout/chute of the filler machine was adequately guarded. Employees tasked with operating the equipment were exposed to hazards created by the rotating gate, which was located inside of the spout/chute.

29 CFR 1910.212(a)(3)(iii): Special hand tools for placing and removing material(s) was not provided to permit easy handling of material without the operator placing a hand in the danger zone: The hand tools provided by the employer did not prevent employees from contact with the rotating gate, located inside the spout/shout of the filler machine. Employees were tasked with scrapping residual molten cheese from the spout/chute of the filler machine, exposing them to hazards created by the point of operation and rotating parts of the machine.
