29 CFR 1926.1053(a)(3)(i): Rungs, cleats, and steps of fixed ladders were spaced more than 14 inches (36 cm) apart, as measured along the ladder's side rails:    (a) New residential construction on Lot #181, First floor: On or about August 30, 2016 and at times prior, the employer exposed employees to fall hazards of up to 10-feet, 4-inches to the lower concrete surface, in that the floor truss used as a ladder had cleats that were spaced approximately 17-inches apart which did not allow for safe access to the upper and lower levels.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  (a) New residential construction on Lot #181, First floor stairwell: On or about August 30, 2016 and at times prior, the employer exposed employees to fall hazards of approximately 10-feet, 4-inches to the lower concrete surface, in that the makeshift/job-made ladder did not extend past the upper landing and was not secured to the structure as employees used this truss to access upper and lower levels.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a)  New residential construction on Lot #181, Second floor: On or about August 30, 2016, and at times prior, the employer exposed employees to fall hazards of approximately 10-feet, 7-inches t the lower level, in that a fall protection system was not provided to employees while framing second floor walls.     Chico Construction, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1127283, citation number 2, item number 1 and was affirmed as a final order on 04/20/2016, with respect to a workplace located at Lot #155 Still Pine Bend, Smyrna, GA 30080.    Chico Construction, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 982629, citation number 1, item number 1 and was affirmed as a final order on 09/08/2014, with respect to a workplace located at 2062 Stonewater Creek Road, Lot #11a.
