29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)          a.) Chivers Construction Company, Inc., 2810 Millfair Rd., Fairview, PA 16415, on or about June 29th, 2017 and times prior thereto:  Employees worked with and around hazardous substances including, but not limited to, diesel fuel, oxygen, propylene, and silica during work operations onsite.  The company's Hazard Communication program was missing information including, but not limited to, the following:       1)  The designation of a person(s) and/or position(s) responsible for ensuring the labeling of in-plant containers.   2)  The procedures to review and update label information when necessary.   3)  Updating the current program to include information regarding Safety Data Sheets.   4)  The designation of a person(s) responsible for conducting the hazard communication training.   5)  Information on training of employees when a new hazard is introduced into the workplace.   6) Information regarding informing other employers/contractors of potential hazardous chemicals that their employees may be exposed to at the jobsite(s).

Chivers Construction Company, Inc., 2810 Millfair Rd., Fairview, PA 16415, on or about June 29th, 2017 and times prior thereto:  Employees worked with and around a TopCon brand (model: RL-SV2S; IC: 6050A-RLSV) rotary laser onsite.  The rotary laser was operating for approximately 2 to 3 hours without active use.  Beam shutters, caps or similar were not utilized as a means of protection for employees onsite while the laser was not in active use.
