Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    Location: Shipping & receiving ramp, 249 Boston Street, Topsfield, MA:   On or about 9/12/2017, the employer did not require the operator of the Hyster H70FT forklift to wear a seatbelt.    Or in the alternative;    OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment in a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to operate a powered industrial truck without wearing a seatbelt:     Location: Shipping & receiving ramp, 249 Boston Street, Topsfield, MA:   On or about 9/12/2017, the employer did not require the operator of the Hyster H70FT forklift to wear a seatbelt.

Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    Location: Facility at 249 Boston Street, Topsfield, MA:  On or about 9/12/2017, the extended forks, attached to the Hyster H70FT forktruck, did not have prior written approval from the manufacturer and the capacity/load markings on the forklift were not updated accordingly.
