29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not implement a written permit space entry program that complied with 29 CFR 1910.146:  a) Linden Bulk Transportation 4200 Tremley Point Road, Linden, NJ site - Wash bay:  The employer failed to effectively implement the company's written permit space entry program as described in the " LBT Tank Entry Work Procedure". The procedure which required employees to clean and neutralize the tanks, take oxygen level readings was not always followed.   Employees enter tanks containing chemicals such as but not limited to PolyTHF, Pluracol, and latex during the cleaning process to remove the products that coat the interior walls of the tanks. Employees are exposed to oxygen deficient atmospheres.  Condition noted on or about 11/29/2017.

Employees who access the catwalk and the top of the tank truck to assist during confined space entries are not protected from falls.    Condition noted on or about 11/30/2017.    The Linden Bulk Transportation, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(2), which was contained in OSHA inspection number 1041033, citation number 1, item number 1 and was affirmed as a final order on 9/1/2015, with respect to a workplace located at4200 Tremley Point Road, Linden, NJ.
