29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    (a)BH Construction & Homes, LLC at 2505 South Moss Stone Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 18, 2017, the exposing employer did not ensure that each employee was protected from falls from heights, in that two employees were conducting siding operations on pump jack scaffolding with no fall protection system in place. This condition exposed employees to a fall hazard of approximately 12 feet 10 inches.

29 CFR 1926.451(b)(3): The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling:    (a)BH Construction & Homes, LLC at 2505 South Moss Stone Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 18, 2017, the employer did not ensure that each employee was protected from falls from heights, in that two employees were conducting siding operations on pump jack scaffolding that the edge of the scaffolding platform was 16 inches away from the wall being sided. This condition exposed the employees to a fall hazard of approximately 12 feet 10 inches.

This condition exposed the employees to a fall hazard of approximately 12 feet 10 inches.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used.  Crossbraces shall not be used as a means of access.    (a)BH Construction & Homes, LLC at 2505 South Moss Stone Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 18, 2017, the employer did not ensure that each employee was provided a safe means of access to the scaffolding system. Employees were using cross-braces as a means of access to the platform. This condition exposed employees to a fall hazard of approximately 12 feet 10 inches.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.     (a)BH Construction & Homes, LLC at 2505 South Moss Stone Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 18, 2017, the exposing employer did not ensure that each employee that was working from scaffolding systems were trained to recognize the potential hazards associated with the work being done and the system being used. This condition exposed employees to fall hazards of approximately 12 feet 10 inches.      Abatement Note:  The training shall include the following elements at a minimum:       (1)The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;       (2)The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:       (3)The proper use of the scaffold, and the proper handling of materials on the scaffold;       (4)The maximum intended load and the load-carrying capacities of the scaffold used; and       (5)Any other pertinent requirements of this subpart.

This condition exposed the employees to a fall hazard of approximately 12 feet 10 inches.
