29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     (a)BH Construction & Homes, LLC at 3801 Technology Drive, Sioux Falls, SD 57105: On or about and at times prior to January 9, 2018, the exposing employer did not ensure that employees were properly trained to operate the Terex Rough Terrain Forklift Model #TH842C being used on site. This condition exposed the employees to the hazard of improper forklift operation.       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.     Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    (a)BH Construction & Homes, LLC at 3801 Technology Drive, Sioux Falls, SD 57105: On or about and at times prior to January 9, 2018, the exposing employer did not ensure employees were protected from serious injury during the use of an elevated work platforms that was not connected to the mast of the Terex Rough Terrain Forklift model # TH842C.  This condition exposed employees to a fall hazard and crushing hazards related to the platform separating from the mast and/or forks.    Abatement Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.    Abatement note:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2001, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks", Section 8.24.1, Platforms for Elevating Personnel, in the following area: Paragraph (h) which states, "a means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting."

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a)BH Construction & Homes, LLC at 3801 Technology Drive, Sioux Falls, SD 57105: On or about and at times prior to January 9, 2018, the exposing employer did not ensure that each employee was protected from falls from heights, in that two employees were conducting roof sheathing operations on a commercial building with a 6/12 pitch with no fall protection system in place. This condition exposed the employees to a fall hazard of approximately 11 feet 4 inches.

This condition exposed employees to fall hazards of approximately 8 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step:    (a)BH Construction & Homes, LLC at 3801 Technology Drive, Sioux Falls, SD 57105: On or about and at times prior to January 9, 2018, the exposing employer did not ensure that employees were using an eight-foot Keller A-frame ladder properly, in that employees were using the top step of the ladder to gain access to the roof truss system. This condition exposed employees to a fall hazard of approximately 11 feet.
