29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)BH Construction & Homes, LLC at 1110 East Madison Street, Tea, SD 57064: On or about and at times prior to January 2, 2025, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting framing operations on a single-family residential property without the use of a fall protection system, a lack of use of eye protection while using pneumatic nail guns, and a lack of an installed stair railing system.  This condition exposed employees to a variety of hazards while working on site.
