OSH ACT of 1970 Section (5)(a)(1): OSHA ACT of Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees exposed to being struck by and /or crushed by unsupported plywood bundles:    a) Railroad Boxcars at Inbound Dock Doors - Employees were required to work adjacent to unsupported plywood bundles weighing 1,852 pounds, standing on-end within dense packed box cars, exposing employees to a struck-by hazard from tipping/falling on-end plywood bundles, as occurred on or about November 28, 2018.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments; however, the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:    (a) Warehouse - The Toyota sit-down rider forklift, model 8FGCU25, serial number 66551, did not have a nameplate and markings for its Rightline single-double attachment but rather had a nameplate and markings for a side-shifter attachment, exposing employees to the hazard of overloading the forklift, on or about November 28, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(4))(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely:    (a) Warehouse - The employer did not provide refresher training and an evaluation on the training's effectiveness to each powered industrial truck operator involved in an accident or near-miss incident, including to an operator who drove a clamp truck into a pole, resulting in a chest injury requiring 32 days away from work, on or about November 10, 2018.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
