29 CFR 1918.66(c)(5): Platforms or devices used to hoist employees were not removed from service when they were found to be defective. "Star Care": Employees were hoisted onto "Star Care" by the Lakeshore Industrial, Inc. custom cage man basket. The safety placards on the cage were illegible, specifically where employees are to attach their personal fall arrest system lanyards to an anchor point. Employees were exposed to fall hazards up to 30 feet to the lower level.

29 CFR 1918.85(l): When an employee was working along an unguarded edge where a fall hazard existed, the employer did not ensure the employee use fall protection meeting the requirements of 29 CFR 1918.85(k). Onboard "Star Care": Employees were working on top of containers performing unlashing operations. A longshoreman was standing on an open-sided edge and his full body harness was not adjusted properly. The chest strap was positioned near the neck and the dorsal dee-ring was at his lower back. The employee was exposed to fall hazards of approximately 20 feet to the lower level.
