29 CFR 1910.147(c)(2)(i): Where an energy isolating device was not capable of being locked out, the employer's energy control program under 29 CFR 1910.147(c)(1) did not utilize a tagout system: (a) Concrete Mixing Tower - On or about 23 MAY 2019, the employer did not ensure that a tagout system was utilized after the employer determined that the Concrete Mixing Plant conveyor belt was not capable of being locked out. Employees were not disconnecting and locking out the power nor performing tag out of the Concrete Plant before performing maintenance.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): a) Concrete Mixing Tower- On or about May 23, 2019, the employer failed to provide clear energy control procedures to be followed during servicing and maintenance of machinery and equipment. Procedures were not developed to control hazard energy sources while engaged in servicing and maintenance of equipment, to include the conveyor systems, exposing employees to potential amputation hazards.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: a) Concrete Mixing Tower - On or about May 23, 2019, the employer failed to ensure that a periodic inspection of the general energy control procedure contained within their written Energy Control Program (Lockout/Tagout Program), was conducted at least annually. Abatement Note: a. Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.1910.147(c)(6)(i)(D) b. Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.1910.147(c)(6)(ii) c. The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
