29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph:  a) Delmarva Corrugated Packaging facility at 1601 POW/MIA Parkway Dover, DE 19904: On or about June 2, 2021, the employer did not provide or maintain a hazardous communication program to include labels and other forms of warning, safety data sheets, and employee information and training as required.  Employees and a manager on site had no understanding or knowledge of the program, training, hazardous listing requirements or SDS information as required.    ABATEMENT NOTE:  A written program shall include description of how the criteria for the following will be met:  1.  Labeling and other forms of warning; 2.  Material Safety Data Sheets; 3.  Employee information and training  Additionally, a list of hazardous chemicals known to be preset in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of material safety data sheets, must also be addressed.  The written program must be made available upon request.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Delmarva Corrugated Packaging facility at 1601 POW/MIA Parkway Dover, DE 19904: On or about June 2, 2021, the employees on site as well as the manager was not able to provide any type of knowledge to the companies HazCom program and was not able to produce or provide required SDS sheets/information for hazardous chemicals being used on the site to reference in case their was an exposure.

29 CFR  1926.28:  Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  a)  Delmarva Corrugated Packaging facility at 1601 POW/MIA Parkway Dover, DE 19904: On or about June 2, 2021, employee was operating a front discharge concrete mixing truck with in a building to delivery concrete for the flooring area of the building with several construction operations going on in the facility with out wearing the required personal protective equipment (seat belt).

29 CFR  1926.601(b)(4):  The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle.  a) Delmarva Corrugated Packaging facility at 1601 POW/MIA Parkway Dover, DE 19904: On or about June 2, 2021, concrete vehicles were operating inside a manufacturing facility under construction pouring concrete forming the floor area in a very confined space without having any type of audible alarm alerting others of their movement.
