29 CFR 1910.133(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. Employee was exposed to hazards from flying particles due to the fact that a face shield that was provided by employer was not used by employee as directed while cleaning/polishing parts on an Enco lathe (SN 1270380).?

29 CFR 1910.212(a)(1): One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. At the establishment located at 645 Leeward Court West, Oshkosh, Wisconsin; the employer did not provide one or more methods of machine guarding to protect the operator in the machine area in the following instances: a) ?Employee was exposed to caught-in/entanglement hazards due to the fact that the guarding that employer provided and directed the employee to use for the rotating chuck of the Enco lathe (SN 1270380) was not utilized by employee during operation to prevent contact with the rotating chuck while cleaning/polishing of parts.? b) On or about and at times prior to December 26, 2022, employees were exposed to caught-in/entanglement hazards due to the fact that emery cloth was held by hand on rotating parts on the Enco lathe (SN 1270380) during cleaning/polishing of parts.
