29 CFR  1910.132(a):Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers was not provided, used, and/or maintained.   a) At the facility:  The employer did not provide personal protective equipment for extremities such as bite/cut resistant arm sleeves.  On 01/11/2023 an employee was bitten on the forearm by a resident.  Condition was noted on or about 01/18/2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR  1904.29(b)(3): The employer did not enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.   a) At the facility:  The employer did not enter a recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.  Employer did  not record an injury that occurred on January 2, 2023 when an employee was punched in the right temple by a student trying to get her attention.  Condition was noted on or about 01/18/2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.
