29 CFR  1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:   a) East Wing - 2nd and 3rd floor:   On or about 12/15/23 and continuing:  Employees wearing half face air purifying respirators were required to use the respirators during demolition work (e.g., grinding/cutting of metal door frames and debris clean up ) and the employer did not develop and implement a written respiratory protection program.  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   a) East Wing - 2nd and 3rd floor:   On or about 12/15/23 and continuing:  Employees wearing half face air purifying respirators were required to use the respirators during demolition work (e.g., grinding/cutting of metal door frames and debris clean up, etc. ) and were not provided a medical evaluation to determine their ability to use a respirator. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

29 CFR  1926.1101(l)(2):   Asbestos waste, scrap, debris, bags, containers, equipment, and contaminated clothing consigned for disposal was not collected and disposed of in sealed, labeled, impermeable bags or other closed, labeled, impermeable containers:  a) East Wing - 2nd Floor - Open HVAC Chase at Wall Across from Room C-208:     Friable asbestos containing material (e.g, thermal system insulation debris) that had been removed from plumbing pipes was left sticking out of the wall  opening for the chase on about; 2/16/24.  b) East Wing - 2nd and 3rd Floors - Pipe/Valve access ways:   Friable asbestos containing material (e.g., thermal system insulation debris) removed from piping was present on or about 2/16/24.
