29 CFR  1926.1101(k)(2)(ii): The facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would  be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing, or a personal communication between the owner and the person to whom notification must be given or their authorized representatives:  a) 2nd Floor East Wing - Shower Room C227A and Janitor's Closet C225:   The facility owner did notify the employer of employees that performed worked next to including but not limited to ceiling framing, wall framing, installing hangars by firing fasteners into overhead concrete decking using a 22 caliber fastener gun, etc. in the area as to the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) in this room;  on or about  on or about 7/25/24 through 7/29/24.  b) 2nd Floor East Wing:   The facility owner did not notify the employees of the owner working in the 2nd floor East Wing of the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) in Shower Room C227A and Janitor's Closet C225; on or about or about 7/25/24 through 12/4/24.   c)  Open Storage Room near Loading Dock:   The facility owner did not notify the employees of the owner working who entered this room and worked in adjacent areas of the presence, location and quantity of asbestos containing material (ACM)(e.g., thermal system insulation debris containing acm, etc.) were scattered on the floor of the room and not stored in impermeable bags or other closed, labelled, impermeable containers; on or about 11/22/24.  Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1101(l)(4)(ii): Waste and debris and accompanying dust in an area containing accessible thermal system, surfacing ACM/PACM, or visibly deteriorated ACM was not promptly cleaned up and disposed of in leak tight containers:  a) Open Storage Room near Loading Dock:   Friable asbestos containing material (ACM) including but not limited to thermal system insulation debris and surfacing material debris were not promptly cleaned up and disposed in leak tight containers; on or about 11/22/24.  b) East Wing - 2nd Floor - Janitor's Closet C225:   Friable asbestos containing material (ACM) debris including but not limited to thermal system insulation and surfacing material debris were not promptly cleaned up and disposed of in leak tight containers; on or about 12/4/24.  In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19
