OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious crushed-by and struck-by hazards while operating powered industrial trucks without seat belts:  a) At the yard, located at 1709 Turkey Creek Road, Plant City, FL: On or about 2/24/2023, employees operating powered industrial trucks (forklifts) were exposed to ejection, struck by and crushed-by hazards.

29 CFR  1910.22(d)(2): The employer did not ensure that hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired.  (a) At the yard, located at 1709 Turkey Creek Road, Plant City, FL: On or about 2/24/2023, the employer exposed employees walking and working in and operating forklifts throughout to trip, fall, and ejection hazards, in that the walking-working surface in the yard was not maintained free of potholes. Three potholes were identified and were measured as 51" long, 40" wide, and 1" deep; 41" long, 23" wide, 0.5" deep; and 26" long, 24" wide, 0.5" deep.
