29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  (a) Soup Packing Line - The employer did not conduct an annual periodic inspection of the lockout/tagout procedure for the metal detector conveyor (with the Lock Inspection Systems MET 30+ head, serial number 40842/2), in accordance with the standard, exposing employees to machinery hazards, on or about August 30, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Soup Packing Line - On the end where soup containers entered, the metal detector conveyor did not have guarding where the modular plastic belt ran over the rotating horizontal square shaft, and the shaft did not have guarding for several inches along both ends, exposing employees to hazards created by ingoing nip points and rotating parts, on or about August 22, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casings enclosing shafting completely or by troughs enclosing sides and top or sides and bottom of shafting:  (a) Soup Packing Line - On the end where soup containers exited, the powered horizontal square shaft on the metal detector conveyor did not have guarding where the modular plastic belt ran over the shaft, and the shaft did not have guarding for several inches along both ends, exposing employees to hazards created by ingoing nip points and rotating parts, on or about August 22, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) Soup Packing Line - The metal detector conveyor, with Lock Inspection Systems MET 30+ head, serial number 40842/2, had electrical and pneumatic energy sources.  The employer's written machine-specific procedure for this piece of equipment did not include pneumatic energy (which powered the reject pusher) and so did not include steps for how to de-energize and lockout/tagout the pneumatic energy, exposing employees to getting struck-by and caught-in moving machine parts, on or about August 30, 2023.  Winter Gardens Quality Foods, Inc. was previously cited for a violation of this occupational safety and health standard CFR 1910.147(c)(4)(i), which was contained in OSHA inspection number 1556141, citation number 1, item number 1 and was affirmed as a final order on February 2, 2022, with respect to a workplace located at 304 Commerce Street, New Oxford, PA 17350.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
