29 CFR  1926.1427(a): General requirements for operators. The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section.  a) Lot #202: On or about 10/19/2023, the employer exposed employees to struck-by hazards while in the process of installing roof trusses with a truck-mounted mobile crane, in that the crane operator was not certified or licensed to operate the Terex BT3470 Telescoping Hydraulic Boom Crane.  Framing Solutions and Crane Services, LLC was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1427(a), which was contained in OSHA inspection number 1478664, citation number 1, item number 1 and was affirmed as a final order on 08/20/2020, with respect to a workplace located at (Lot 152 ) 4736 Albany Way, Atlanta, GA 30031.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Second floor top plate: On or about 10/19/2023, and at times prior, the employer exposed employees to fall hazards of approximately 21-feet, 11-inches to 25-feet (depending on the side) to the lower ground level, in that a fall protection system was not provided to employees engaged in roofing activities.  Framing Solutions and Crane Services, LLC was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1454524, citation number 2, item number 2 and was affirmed as a final order on 05/22/2022, with respect to a workplace located at (Lot 65Q) 6461 Crosscreek Lane, Flowery Branch, GA 30542.
