29 CFR 1960.8(a): The agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to oxygen deficient atmospheres while testing confined and enclosed spaces and other dangerous atmospheres.    a) Norfolk Naval Shipyard, CVN-77, JP5 tank 8-104-3-J: On or about December 07, 2023, a Naval Competent Person tested a layered atmosphere without using a drop test or inserting probes or hoses prior to entry into the tank resulting in the employee being exposed to an oxygen deficient environment.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
