29 CFR  1910.28(b)(1)(i)(A): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a standard guardrail system.   On or about June 25, 2024 and at times prior thereto, near 22-2P-253 A/B LCO pumps in FCCU 22 Unit, employees access the first level of two platforms along the corridor that were more than four(4) feet in height and the walking-working surface did not have a complete guardrail system installed.

29 CFR  1910.37(a)(3): Exit route(s) were not kept free and unobstructed:    On or about June 25, 2024, the employer did not ensure the south exit at the Crude 32 Unit Old Control Room was free and unobstructed from the outside. The old control room was being used to store lockers and harnesses, etc. for operators. This working condition exposed employees to potential fire and smoke hazards in the event of fire emergency.

29 CFR  1910.119(d)(3)(ii): The employer  did not document that equipment complies with recognized and generally accepted good engineering practices (RAGAGEP).   On or about June 25, 2024, the employer did not ensure that the nameplate on pressure vessels was visible as required by their adopted RAGAGEP ASME Boiler and Pressure Vessel Code Section VIII Division 1 (1968 Edition) Part UG-116 (a) for nameplate per UG-116 (i) for required marking: All required markings shall be located in a conspicuous place on the vessel, preferably near a manhole or handhole.  This condition exposed employees to chemical release hazards for the following equipment: a) Crude Unit  Desalter (32-CD2) b) FCC Unit Hot Oil Surge Drum (22-D201)

29 CFR  1910.119(e)(5): The employer did not establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions.   On or about June 25, 2024, the employer did not either resolve or document resolution, and or interim measures that were completed, in a timely manner for the 2018 PHA team?s finding and recommendation for Debutanizer Tower 22-3V103.
