(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.     a) On December 12, 2024, the employer failed to ensure that an employee was utilizing a fall protection system when performing roofing work while standing on the mid-rail of an elevated scissor lift. As a result, an employee was exposed to a fall hazard of 16'9'' above the ground below.

29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On December 12, 2024, the employer failed to ensure that employees performing roofing activities on a commercial roof with unprotected sides and edges were utilizing a fall protection system. As a result, employees were exposed to a fall height of 16'9''.    Chacon Drywall, LLC was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501 (b)(1), which was contained in OSHA inspection number 1758621, citation number 1, item number 2 and was affirmed as a final order on 10/17/2024, with respect to a workplace located at 151 N Stewart Road, Liberty, Missouri, 64068.
