29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d):  a) Jobsite located at or near 650 Red Bone Road, Chester Springs, PA - On or about  April 4, 2025, the employer did not ensure that the powered industrial truck (PIT) operator operating PITs such as, but not limited to, the JLG telehandler successfully completed training and evaluation to ensure the operator has the knowledge and skills needed to operate the powered industrial trucks safely, thereby exposing employees to caught in-between and fall hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a) Jobsite located at or near 650 Red Bone Road, Chester Springs, PA - On or about  April 4, 2025, the employer did not ensure that employees working on an elevated platform were adequately attached to the forks. Employees occupied the platform while it was in movement.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite located at or near 650 Red Bone Road, Chester Springs, PA - On or about  April 4, 2025, the employer did not provide effective training to employees who was exposed to fall hazards during residential construction activities.  Employees were performing framing and sheathing of a home without fall protection training, thereby exposing employees to falls of approximately 10 feet.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Jobsite located at or near 650 Red Bone Road, Chester Springs, PA - On or about  April 4, 2025,  the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected guardrail systems, safety net system, or personal fall arrest system. Employees were performing framing activities without the use of fall protection, thereby exposing employees to falls of approximately 10 feet.  America First Contractors, LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1720813, citation 2, item number 1 and was affirmed as a final order on April 15, 2024,  with respect to a workplace located at 5 Charlotte Court, Marlton NJ 08053.  America First Contractors, LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1702334, citation 1, item number 1, and was affirmed a final order on February 7, 2024, with respect to a workplace located at 1 Charlotte Court, Marlton NJ 08053.  America First Contractors, LLC was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1643491, Citation 1, Item Number 1, and was affirmed as a final order on March 24, 2023, with respect to a workplace located at Nelson's Way, Westampton, NJ 08060.
