29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a. On or about February 3, 2015, at the open stairwell, the aluminum extension ladder used by employees to access the second-floor did not extend 36 inches above the upper landing surface, exposing employees to a 10 feet fall hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. Employees performing residential framing work at elevations of six feet or more above the ground are not protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on February 3, 2015, when employees were installing framing from the first and second story of a residential house at 25 Molasses Court, Saint Johns, Florida 32259 without fall protections and were exposed to fall hazards of 10 and 11 feet above the concrete foundation and surrounding ground. Transformers Construction Services, Inc. previously committed a Willful violation of this standard with an 11(b) warning on April 10, 2014, when employees were working on a residential house at 62 Stirlingshire Court, Saint Augustine, Florida, 32259, which became a Final Order on August 6, 2014. (Inspection No. 967068) Transformers Construction Services, Inc. previously committed a Repeat violation of this standard on January 17, 2014, when employees were working on a residential house at 106 Cantley Way, Saint Augustine, Florida, 32259, which became a Final Order on April 2, 2014. (Inspection No. 955478) Transformers Construction Services, Inc. previously committed a Repeat violation of this standard on January 15, 2014, when employees were working on a residential house at 1274 Camp Ridge Lane, Middleburg, Florida, 32068, which became a Final Order on May 5, 2014. (Inspection No. 955068) Transformers Construction Services, Inc. previously committed a Repeat violation of this standard on October 17, 2013, when employees were working on a residential house at 95076 Lilac Drive, Fernandina Beach, Florida, 32034, which became a Final Order on November 18, 2013. (943263) Transformers Construction Services, Inc. previously committed a Serious violation of this standard on November 21, 2011, when employees were working on a residential house at 12298 Water Tupelo Street, Jacksonville, Florida, 32226, which became a Final Order on February 1, 2012. (315481929) To abate this violation, the employer must ensure that all employees wear appropriate fall protection or install a guardrail or safety net system when an employee works above 6 feet off the surface. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including and explanation of how these steps protect its employees from fall hazards.
