29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   The employer did not provide the Occupational Safety and Health Administration certification and documentation of abatement as required for Citation #1, Item #1 issued April 24, 2020 .

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501:  Employees engaged in residential framing activities at the jobsite located at Lot 20 126th St. Ter and S. Aurora St. in Olathe, Kansas, were exposed to fall hazards of approximately 30 feet from the eave of the roof to the ground below in that fall protection was not used or provided.  BGC Construction, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1426662, citation number 1, item number 3 and was affirmed as a final order on 1/30/2020, with respect to a workplace located at 16079 Fontana St. in Overland Park, Kansas.  BGC Construction, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1439849, citation number 1, item number 3 and was affirmed as a final order on 1/10/2020, with respect to a workplace located at 23236 W. 89th Street, Lot 19 in Lenexa, Kansas.
