29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer did not provide the Occupational Safety and Health Administration certification of abatement as required for Citation #1, Item #1,issued April 24, 2020.    29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Employees were exposed to struck-by hazards.  At the jobsite located at 88th and Findley in Olathe, KS:  Employees engaged in ground work activities were exposed to struck-by hazards from falling tools or materials in that hard hats were not provided or used.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501:  Employees engaged in residential framing activities at the jobsite located at 1105 W. Ashbury Street. in Olathe, Kansas, were exposed to fall hazards of approximately 20 feet from the eave of the roof to the ground below.  Fall protection was not used or provided.  BGC Construction, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1426662, citation number 1, item number 3 and was affirmed as a final order on 1/30/2020, with respect to a workplace located at 16079 Fontana St. in Overland Park, Kansas.  BGC Construction, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1439849, citation number 1, item number 3 and was affirmed as a final order on 1/10/2020, with respect to a workplace located at 23236 W. 89th Street, Lot 19 in Lenexa, Kansas.
