29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The Employer did not provide the Occupational Safety and Health Administration (OSHA) certification of abatement as required for Citation #1, Item #1 and Citation #2, Items #1 & #2.  BGC Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1903.19(c)(1), which was contained in OSHA Inspection #1467088, Citation #3, Item #1 issued 8/3/2020 and was affirmed 8/14/2020, with respect to a worksite located at 88th Terrace & Findley, Lot 51, Lenexa, Kansas.    29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  Employees were exposed to electrical shock hazards at W. 126th Terrace, Lot 20, Building 26, Lenexa, Kansas  66212 in that extension cords had broken outer jacket insulation, exposing wires that had heated and melted parts of the insulation.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  Employees were exposed to struck-by hazards.  At the jobsite located at W. 126th Terrace, Lot 20, Building 26, Lenexa, Kansas.  Two employees engaged in ground work activities were exposed to struck-by hazards from falling tools or materials in that hard hats were not provided or used.  The BGC Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 1467088, citation number 1, item number 1 and was affirmed as a final order on 5-19-2020, with respect to a workplace located at 88th and Findley in Olathe, KS.

Employees engaged in framing activities using pneumatic nailers while installing 2nd level floor joists, were exposed to struck-by hazards in that eye protection was not provided or used.  The BGC Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1426662, citation number 1, item number 2 and was affirmed as a final order on 1-30-2020, with respect to a workplace located at 16079 Fontana St. Overland Park, KS.

The BGC Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1467088, citation number 2, item number 1 and was affirmed as a final order on 5/19/20, with respect to a workplace located at 1105 W. Ashbury Street in Olathe, Kansas.  The BGC Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1466097, citation number 1, item number 1 and was affirmed as a final order on 5/19/20, with respect to a workplace located at Lot 20 126th St. Ter and S. Aurora St. in Olathe, Kansas.
